All terms are severable and therefore any clause found to be unenforceable would not affect the validity of any other clause.
Any failure of the company to enforce any of its rights within this agreement, either intentionally or unintentionally does in no way imply any waiver of any rights.
Definitions
Client/Customer/you/your refers to you, the individual or Company requesting the cleaning service from Domestique Ltd. We/Us/The Company/Domestique refers to Domestique Ltd. Housekeeper refers to any cleaner introduced by the Company to the Client.
- This Agreement becomes effective when signed by both the Company and the Client.
- A 7 day ‘cooling off’ period is provided by law. However, if you request or accept the commencement of our service prior to the seven days elapsing it is agreed that you have waived your seven day cancellation right.
- In line with the service level agreed as indicated overleaf and these Terms and Conditions the Company will supply an insured and vetted Housekeeper on a regular basis until the Agreement is terminated by either party. Exceptionally the Company may substitute the Housekeeper for another with greater or lesser experience and service length in order to continue the service.
- Payment to the Company is quarterly/monthly in advance, by standing order/direct debit at the rate agreed and indicated overleaf. Payments are subject to review and will continue until this Agreement is terminated.
- Standing orders/direct debits will be presented when a service start date is agreed or if clause 20 is used.
- The Housekeeper is introduced to the Client by the Company as a self employed Housekeeper. The Client is responsible for the employment of any Housekeeper and the Client retains the Housekeeper under a “Contract for Services”. Any specific arrangements and agreements should be agreed between the Client and the Housekeeper directly. The Client is responsible for prompt payment of the Housekeeper at the agreed hourly rate shown overleaf. This rate may be varied by the Company from time to time to ensure Housekeepers are being paid appropriate rates of pay.
- If the Client allows the Housekeeper keys to any property the Client remains responsible for the collection of the keys.
- Once the Housekeeper has begun work we will levy a charge equivalent to 70% of the quarterly charge to cover our costs if the service is cancelled within the first 13 weeks unless clause 21 is used.
- The Company cannot cancel a standing order once set up and it is therefore the Client’s responsibility to cancel any standing order if the Agreement is terminated. The Company will cancel any direct debits upon written instruction to do so.
- If the Client fails to cancel a standing order the Company reserves the right to charge an administration fee not exceeding £27.50 per incident.
- The Client will provide all cleaning materials and authorise use of all equipment including a fault free, working vacuum cleaner and iron (if necessary).
- Insurance covers any Housekeeper employed by the Client and introduced by the Company and retained by the Client. We hold public liability insurance to a maximum payout of £1,000,000. Neither Domestique or its insurers shall be liable for the first £100 of any claim nor for any claim of £100 or less. The Client should have adequate insurance cover in place against liabilities to the Housekeeper and shall produce to Domestique a copy of the appropriate insurance policy if so requested (this may be in the form of a general household insurance policy).
- The Company accepts liability in the event of death or injury to any person arising out of the negligence of the Company or its agents or employees.
- The Company will not accept liability for any chemical damage as we will only use the materials supplied by the Client and the Housekeeper should be properly instructed by the Client on how to use these chemicals.
- The Company can terminate this Agreement at anytime giving reasonable notice – usually not less than four weeks. During the notice period ongoing provision of a Housekeeper is at the Company’s discretion.
- The Client can terminate this Agreement giving not less than four weeks notice in writing. Notice will be deemed given upon receipt at our office.
- For a period of twelve months after termination of this Agreement the Client cannot employ any Housekeeper previously introduced by the Company. The Company has the right to recover a full years fees plus costs from any Client that employs a Company introduced Housekeeper without paying the Company fee.
- If at any time the Client directly or indirectly approaches the Housekeeper to engage their services privately without the knowledge and agreement of the Company, or accepts any such approach from the Housekeeper, the Client will immediately be in breach of the Agreement and the Agreement will cease and the Company will seek payment of twelve months fees through a legal claim.
- During the Agreement and for a period of 12 months after termination of this Agreement the Client agrees not to refer any Housekeeper to another person except by going through the Company, to do so would be a breach of this Agreement.
- If the Client cancels this Agreement prior to service starting a charge equivalent to one month’s fee will be applied unless clause 2 is used.
- We guarantee that if you are not happy with your first Housekeeper after two cleaning sessions we will replace him/her with an alternative Housekeeper. If after a further two cleaning sessions you are still unhappy we will offer you the option to cancel and we will refund all charges paid to the Company for the first quarter/month. This guarantee is only effective if the Client affords the Company the opportunity to remedy the perceived service shortfall.
- Refunds. We are happy to offer a refund if through the fault of the Company or your Housekeeper no service is provided. We do however need you to notify us within four days of an absence occurring in order to claim a refund and we will require a copy of the signing on sheet clearly indicating the missed cleaning session. We will not issue a refund if you have requested that no service is provided or if any action on your behalf prevents the Housekeeper from gaining access to the property. No refunds will be issued for exceptional situations such as severe weather conditions or pandemics or any associated complications or any other circumstances beyond our control that prevent the Housekeeper from attending for work.
- We cannot supply replacement cleaners during Easter or Christmas week should your Housekeeper choose not to work.
- In line with the service level agreed we will make every effort to supply a replacement Housekeeper at any other time should your Housekeeper fall ill or for any other reason is unable to work. In order to do so we need your co-operation and flexibility.
- The Company reserves the right to amend the Terms and Conditions of this Agreement, and shall inform the Client of such changes by posting them on the website/s operated by the Company, and/or by sending or otherwise providing them to the Client not less than thirty days before implementation of such changes.
